Behind the Bylaws: Start Here
Welcome to Behind the Bylaws, our six-part series designed to help you better understand the proposed amendments to the Longleaf Pine REALTORS® Bylaws.
Over the next six weeks, I’ll walk you through the proposed changes to the association’s bylaws. My goal is to explain what’s changing, why those recommendations are being made, and what they mean for you as a member – all in a straightforward, easy-to-understand format.
This series will lead up to a membership vote on the proposed bylaws at the August 18th Member Luncheon.
Why Are We Reviewing the Bylaws?
The association’s bylaws serve as the governing framework defining how Longleaf Pine REALTORS® operates. The various provisions of the bylaws establish membership requirements, outline leadership responsibilities, and guide many of the decisions that affect our organization.
Like any governing document, bylaws are reviewed regularly to ensure they remain current and reflect today’s legal requirements, National Association of REALTORS® guidance, and the operational needs of our Association.
The proposed changes to the bylaws covered in this series are the result of a comprehensive review by the Bylaws Committee that included:
- Recommendations from legal counsel
- Modernization of outdated language.
- Alignment with current Association practices.
- Clarification of existing procedures.
Many of the proposed revisions are administrative or housekeeping changes, while others provide important governance updates.
What’s Covered This Week?
This week’s update focuses on Articles 1–6.
- Review the red-lined version: Red-lined Bylaws
- Review the clean version: Clean Bylaws Draft
- Visit the Bylaws Review Hub: Bylaws Review Hub
Article 1: Name
A simple grammatical correction is proposed. There are no operational or governance changes.
Article 4: Membership
No changes made.
Article 2: Objectives
The proposed amendments update the Association’s objectives, so they align with our Articles of Incorporation and recognize Longleaf Pine REALTORS® as a 501(c)(6) professional trade association.
These revisions do not change our mission or the services we provide. They simply ensure our governing documents accurately reflect who we are as an organization.
Article 5: Qualifications and Election to Membership
Several recommendations clarify membership qualifications and application procedures, including language addressing recent bankruptcy and unresolved disciplinary sanctions from another REALTOR® association.
These recommendations are intended to strengthen consistency with National Association guidance while protecting both the Association and its members.
Article 3: Jurisdiction
No changes made.
Article 6: Privileges and Obligations
Several updates modernize existing language and remove outdated instructional notes.
One noteworthy recommendation involves the Association’s harassment policy. Rather than including detailed policy language directly in the bylaws, the proposal references the Board-adopted policy contained in the Association’s Policy Manual.
This allows the policy to be updated as laws and best practices evolve without requiring a formal amendment to the bylaws each time.
